Discrimination & Harassment, Administrative Charges & ADA Compliance

For decades, Cox, Castle & Nicholson has assisted employers in complying with equal employment opportunity laws and defended employers against discrimination, harassment, and retaliation claims in state and federal courts, administrative proceedings, and regulatory investigations. We represent employers with respect to both their California and national operations and are experienced in all types of equal opportunity employment issues faced by employers including:

  • Sex, race, age, religious, sexual orientation, and other forms of discrimination and harassment claims
  • Claims and compliance under the Family and Medical Leave Act (FMLA) and similar state medical leave laws
  • Americans with Disabilities Act (ADA) employment and accessibility claims
  • Unruh Act accessibility claims
  • Compliance with government contracting requirements, including affirmative action and equal opportunity issues

We also have a wealth of experience in defending claims made before federal and state administrative agencies and in defending employers against investigations and audits by such agencies, including:

  • Workers Compensation Act discrimination charges under section 132a of the Labor Code
  • Wage recovery hearings before the State Labor Commissioner (Berman hearings)
  • Discrimination charges filed with the federal EEOC or State DFEH
  • Contesting unemployment benefit claims before the California Employment Development Department (EDD)
  • Workplace injury citations issued by CalOSHA
  • Federal Department of Labor (DOL) investigations
  • Proceedings before the California Division of Labor Standards Enforcement (DLSE)
  • Audits conducted by the EDD or the DLSE

As with all aspects of our Labor and Employment Practice, we stress preventing claims and disputes which lead to costly litigation. To that end, we assist employers in being proactive by reviewing and developing policies, implementing training, counseling on risk management and employee termination decisions, and auditing legal compliance with equal opportunity laws.
